Things could get messy for Machine Head. As it turns out, Adam Duce's exit from the band wasn't that amicable after all. According to Courthouse News, the former bassist has filed a lawsuit against the band and their manager in Federal Court. He seeks damages for trademark infringement, breach of partnership agreement and defamation, among other things. Ouch!

Duce claimed in court that Machine Head kicked out the bassist/co-founder just before signing a new record deal then falsely claimed he had quit the metal band because he was "sick of it." Duce believes he was fired just before the deal was completed with defendant Nuclear Blast America to allow the other band members to make a bigger profit. The band formed a general partnership - Machine Head - and a corporation - Head Machine Touring Inc. - under which each member owned 25 percent. But despite this, co-founder Robb Flynn got a larger portion of the band's income, Duce claims.

"Despite their increase in popularity and touring revenue, plaintiff became concerned with how little income he was receiving, despite the time and hard work put in to developing the band," Duce says in the complaint. He says he questioned Flynn and the band's manager, defendant Joseph W. Huston, but never got a satisfactory answer.

In 2009, Machine Head toured with Metallica in Europe, grossing more than $2 million. A 2012 Europe tour grossed more than $3 million, according to the complaint.

Contrary to popular belief, being in a professional band is about earning a living from playing music. Most such bands are businesses. It involves large outlays (e.g. for recording albums, tours), good management (concerts, merchandise and other marketing) and well thought out contracts specifying all legal rights and obligations.

In fact failing to run it as a business means problems regarding remuneration and mismanagement.


If Robb Flynn was skimming from the top and especially if it was meant to be an equal shares agreement, then that demands some sort of restitution.

I've heard Robb had series of rocky relationships with Phil Demmel( while Through The Ashes Of Empires) and the heat was faced by whole management. This time screwing with Duce wasn't a big deal. Its either Robb like an oxen pulling band's future on his own back and getting hefty amount of share(as said above) that Duce thinking is prejudice or Duce out of the context getting jealous and wants his (un?)forceful share from the band.

But, this corporation - Head Machine has a good way of handling economic budget and it seems to be bit clear that the management can't screwed up. Well, this story just unfolds like firing of Angela Gossow from AE for mismanagement of funds or something like that.

Interesting to see how much such a band makes through touring, had no clear idea. Still think they suck anyway, so best luck to former bassist (if his side of the story is true).

Those are grosses. The net take is going to be a hell of a lot lower. Along with paying for: crew, transportation, equipment, lodging, blow jobs, intoxicants, per diems, food, and enemas, their management, booking, and various vampires will want their cut of the gross. Then they get to split some of it. If they split all of it, how would they pay for any future endeavors? A band is a business and you have to keep investing in it.

That said, it sounds like he has a legitimate beef.

They shouldn't tour with Metallica,obvoiusly Lars Ulrich gave some of his financial methods and
ideas to Rob Flynn so he became arogant greedy bastard...
